CAIRO - 5 May 2026: A new draft family law requires an appendix to be attached to marriage or divorce certificates outlining the rights and obligations of both parties, including a condition that a husband may not take another wife without written permission from his current spouse.
In a Monday statement, details of the draft law’s Article 32 revealed that this legal appendix will have the power of an enforceable document. It allows couples to pre-agree on alimony, mut'a, which literally translates to "pleasure compensation" and it is money the ex-wife takes after divorce, as well various child-related expenses such as breastfeeding and housing fees.
The document also grants the wife the right to request a divorce if the husband marries another without her consent, or the right to divorce herself if such authority is delegated in the contract.
Article 33 of the draft confirms that both spouses maintain independent financial assets.
While they may invest in joint property, the law specifies that household labor or a husband’s standard care for his wife does not automatically entitle either party to the other's personal wealth.
Claims regarding contributions to joint assets must be made within one year of death or separation.
Additionally, Article 34 restricts the legal benefits of undocumented (urfi) marriages.
While women may still sue for divorce or prove the lineage of children from such unions, they will not be entitled to alimony or housing rights unless the marriage is officially documented by a state-authorized official.
